Acceptance of terms
By creating an account, accessing, or using XS Bookly ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
The Service
XS Bookly is a software-as-a-service platform that lets businesses configure booking flows, manage availability, accept customer bookings, and embed a booking widget on their websites. Features may vary by subscription plan.
We may update, improve, or discontinue features at any time. We will use reasonable efforts to notify you of material changes that affect your use of the Service.
Accounts and eligibility
You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity under your account.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
Subscriptions and billing
Prices, plan limits, and billing intervals are shown at checkout and in your dashboard. Taxes may apply based on your location.
For refund eligibility, see our Refund Policy.
Your content and customer data
You retain ownership of the business information, booking data, and customer data you submit through the Service ("Your Data"). You grant us a limited license to host, process, and display Your Data solely to provide and improve the Service.
You are responsible for obtaining any consents required from your customers and for complying with applicable laws when collecting and using their data.
Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or abusive purposes
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer or copy the Service except where permitted by law
- Resell or sublicense the Service without our written permission
We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.
Third-party services
The Service integrates with third-party providers (for example, payment processors, email delivery, and calendar services). Your use of those integrations is subject to the third party's terms. We are not responsible for third-party services outside our reasonable control.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free operation, or that the Service will meet your specific business requirements.
Limitation of liability
To the maximum extent permitted by law, Xino Solutions and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the claim arose, or one hundred US dollars (USD $100), whichever is greater.
Termination
You may cancel your subscription at any time through your account settings or via Paddle. We may terminate or suspend access if you breach these Terms or if required for legal or security reasons.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including payment obligations, disclaimers, and limitations of liability) will survive termination.
Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be communicated by email or in-app notice. Continued use after changes take effect constitutes acceptance.
